1. Acceptance of Terms

By accessing or using sportwizzard ("Service"), operated by sportwizzard LLC ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

sportwizzard is a sports betting data and analytics platform. We aggregate publicly available odds data from sportsbooks and daily fantasy sports platforms, and provide tools for comparing odds, identifying edges, and detecting arbitrage opportunities.

sportwizzard is NOT a sportsbook, gambling operator, or betting exchange. We do not accept, process, or facilitate any bets or wagers. We do not hold customer funds. We do not provide gambling services of any kind. All data is provided for informational and analytical purposes only.

3. Eligibility

You must be at least 18 years old to use this Service. By using sportwizzard, you represent and warrant that you meet this age requirement and that your use of the Service complies with all applicable local, state, and federal laws in your jurisdiction.

4. Account Registration

To access certain features, you may need to create an account through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not create multiple accounts, share account credentials, or transfer your account to another person without our prior written consent.

5. API Usage and Rate Limits

Access to the sportwizzard API is subject to rate limits and usage quotas based on your subscription tier. You agree to comply with the published rate limits and not to circumvent, bypass, or attempt to exceed these limits through any means, including but not limited to:

• Creating multiple accounts to increase your aggregate rate limit
• Using distributed systems to exceed per-key rate limits
• Scraping, crawling, or automated bulk data extraction beyond your API quota

API keys are issued for your personal or organizational use only. You may not share, sell, or redistribute your API key to third parties. Violation of API usage terms may result in immediate suspension or termination of your access.

6. Prohibited Uses

You agree not to use the Service to:

• Resell, sublicense, or redistribute sportwizzard data or API access without our prior written consent
• Build a competing product or service using our data
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with, disrupt, or place an undue burden on the Service or its infrastructure
• Use the Service for any illegal purpose, including but not limited to illegal gambling in jurisdictions where it is prohibited
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Transmit any malware, viruses, or other harmful code

7. Data Accuracy Disclaimer

All data provided by sportwizzard is on an "as is" and "as available" basis. While we strive to provide accurate and timely data, we make no warranties or representations regarding the accuracy, completeness, reliability, or timeliness of any information displayed on or accessible through the Service.

Odds data may be delayed, stale, or incorrect. Market conditions change rapidly and the data you see may not reflect current prices. You acknowledge that any decisions you make based on data from sportwizzard are made at your own risk. We are not responsible for any financial losses, missed opportunities, or other damages arising from your use of or reliance on the data provided by the Service.

8. Intellectual Property

The Service, including all software, algorithms, data compilations, user interfaces, designs, text, graphics, and other content, is owned by sportwizzard LLC and is protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. This license does not include the right to sublicense, resell, or create derivative works from the Service or its data, except as explicitly permitted by your subscription tier.

9. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions are billed on a recurring monthly basis unless otherwise stated.

All fees are non-refundable except as required by applicable law. We reserve the right to change our pricing at any time with 30 days' notice to current subscribers.

10. Limitation of Liability

To the maximum extent permitted by law, sportwizzard LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless sportwizzard LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may cancel your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, limitation of liability, and indemnification provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email notification. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Wyoming.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
